Justice #Barishaki says the extension of the term of parliament in the Constitutional amendment Act 2017 was unconstitutional

The lawyers will quote and detail Section 4 and 8 which violate Article 77 of the constitution.

Justice Barishaki says he agrees with the Age Limit petitioners that public participation in legislative processes in mandatory.

The panel of five justices of the constitutional court led by Deputy Chief Justice Alfonse Owiny Dolo, are in Mbale High Court to deliver their judgment on the age limit petition.

Parliament on December 20 passed the age limit bill before being signed into law by President Museveni seven days later to allow lifting of the cap on the lower and upper age limit from 35 and 75 respectively.

Justice Cheborion says, “Organising elections twice in 2021 for president and 2023 for the MPs is contravening with the wish of the people and I find it unexcitable, and therefore Parliament didn’t have to amend that Act .

Justice Cheborion further says, “If extension of term of office for parliamentarians was done in good faith, then it should have been done starting with the next parliament. ”

Cheborin takes a day, he still insists that extension of term from 5 years to 7 was selfish, contrary to good governance and unconstitutional. It breached the contract with the people and usurped the sovereignty of the people. It is therefore declared to be contrary to the constitution and unacceptable.

According to Barishaki, the parliament by enlarging their term of office to seven years effective this term, parliament arrogated to itself power reserved for the people thus usurping those powers in breach the constitution.

He said the extension is null and void, selfish and goes against the principle of good governance.
