Dr. Stella Nyanzi and her fearless Legal team toast to victory

KAMPALA – Buganda Road Chief Magistrates Court temporarily rejected a move by government to subject Makerere researcher Dr. Stella Nyanzi to mental examination at Butabika hospital on Tuesday.

This means that proceedings against Nyanzi under the Mental Treatment Act (MTA) 1938 will not proceed, pending the determination of Nyanzi’s petition at the Constitutional Court.

But she will only stand trial on charges of cyber harassment and offensive communication, slated to start next month.

“I have evaluated the uncontroverted evidence by affidavit from Dr. Nyanzi and I am satisfied that this is a good case for stay of proceedings under the MTA to allow the Constitutional Court exercise her jurisdiction without this court rendering the applicants petition nugatory,” ruled chief magistrate Ereemye Jumire James Mawanda.Dr. Stella Nyanzi has always been in the lime light for going against the government. She is doing things her own way. Now she has to toast to her no-bribe victory.

He granted my request to halt the state’s demand to subject me to involuntary mental test until the constitutional court judges my petition against the archaic Mental Treatment Act (1938).

He also denied the state’s request for my bail to be cancelled because of claims that my recent Facebook posts break the subjudice rule.

Tomorrow we resume the fight in the constitutional court, and the criminal court. Tonight, we pour libation to all the gods and our ancestors working hard to move our victories against Uganda’s dictators! A big toast to my lawyers, sureties, family, friends and allies who contribute towards all the legal fees.
