Ministry of lands sited in Fraud in respect to Prince Herbert Rwakiswaza Kimera’s

Born of Late   Hezekia Rwakiswaza son of King Kabalega Chwa, Late Herbert Rwakiswaza Kimera was one of the few last grandchildren of the Kabalega lineage.  In 1955 Prince Herbert Kimera Rwakiswaza married Mrs Margret Elizabeth Kabateso Ndahura Kimera at St Peters Cathedral in Hoima. During the marriage they bore children, worked so hard and acquired property, constructed a matrimonial home at Parajwoki, Bulemwa, started a joint partnership with the wife and his brother late Nyabongo and started Kasiro Diary farm which borders the famous Magara Family land.

A forest Ranger by training prince Herbert Kimera ventured into Agriculture and Agro-forestry on more than 6 square miles Kiswaza land inherited from his Father Hezekia Rwakiswaza and the land named after the lineage. Prince Herbert Rwakiswaza Kimera later separated with his wife Mrs. Margret Elizabeth Kabateso Ndahura Kimera and cohabited with other two women and also produced children with them, this was the beginning of the Pandora box. Prince Herbert Rwakiswaza Kimera was the only uniting factor of his polygamous family.

The prince later had a long illness and succumbed to multiple strokes and died on 6th March 2015 at the age of 89 years. Eulogized by many as a real prince, principled, incorruptible, the prince was buried in cold war that every one noticed but never mentioned. The pillar of the family had fallen and the Pandora box was to be opened. During the Burial ceremony a lawyer who claimed to be for the Kimera family from Mamawi, Wamimbi & Co Advocates feared to read the Will amidst tension due to rumors that the Will had leaked.

The will reading was scheduled for another date (two weeks after burial). After reading of the Will, one party had come with a lawyer from M/s Nyanzi, Kiboneka& Mbabazi Advocates who asked for a copy of the Will which was objected by the other party which was suspected and accused of forging the Will. It was confirmed that the rumors that had circulated during the burial ceremony were the real details of the Will the curtain had fallen and the battle lines were drawn. The WILL was only accessed through High Court Masindi where the Kamurasi David Steven accused his brothers of blocking the execution of the Will. We have seen written correspondences where Mamawi, Wamimbi & Co Advocates denying access of the Will to the Administrator General.

During the period when the Will was being hidden from one party, the appointed Executors (Winyi John Bernard, Edgar Philemon Nyabongo and Kabatalya Joyce) were rushing to get letters of probate. One party applied to High court and a caveat was put on the Will.

After instituting civil proceedings in High court Masindi facts started emerging of fraudulent transactions on the estate of the late prince Herbert Rwakiswaza Kimera even in disregard of the fact that there is a court case on going and the fact that the estate has no administrator!

Fraud on LRV 1826 Folio 16 Plot 6 Bugahya Block 6 at Kyabikuti and Muziranduru

The above land is located in the now Buhaguzi county, Kiziranfumbi sub-county Hoima District. It was owned by Omukama Cwa II Kabalega around 1880 and one of his Omugo (Queen) who produced Hezekiah Rwakiswaza Kabaleega around 1888 at a place called Kiswaza where the current Hoima Sugar limited established a sugar plantation and Sugar factory which was commissioned by the president in 2015. One wonders why the land that Prince Herbert Rwakiswaza Kimera said he held in trust for the future generation of the Rwakiswaza family in a letter to the same president would be disposed off in the evenings of his life.

There was a feeling that the young set of Prince Herbert Kimera’ children including Kamurasi David Stephen, Edgar Nyabongo Winyi John Bernard and their mother Filomena Babiha manipulated their aged father and sold off property.

Fraudulent transactions

–       Night transactions. Title LRV 1826 Folio 16 Instrument 476703 was issued at 10.35 PM (at night) and yet systems close at 5pm (evening time) to

–       Wrong instruments back ward instead of forward

–       Transfer of land with caveat

–       Conflict of interest where Kamurasi David Steven who was working with Taremwa and Co advocate which wrongfully removed a caveat is a beneficiary

–       Transaction had been done on land before the leter from Taremwa &Co Advocates

 B) Fraudulent transfer of plot 8, Vol 902 Folio11

This land is ancestral and has a clan burial ground for not only our father but also other Rwakiswaza’s children and other relatives because our father inherited it from his late father Hezekiah Rwakiswaza. Early this year concerned family members sat in a meeting and acknowledged the need to have the grave yards at Parajwoki renovated and on the 11th/August/2016 Princess Beatrice Kimera was entrusted to lead a team to go and have the work done and during the renovation of the graves and weeding around some crops which were near the grave yard were removed so that the ground could be leveled to avoid water from entering the grave yard. After the removal of the crops, they were replaced with grass to absorb the soil and water. During the process of renovation   Kamurasi David Steven and Winyi Benard came with a Crime intelligence officer Called Gerald Byabagambi attached to Hoima

CPS. Kamurasi threatened a casual worker doing renovation with arrest in the presence of Princess Beatrice Kimera, He later removed the planted grass and also reported Malicious Damage and threatening Violence against his threat victim Princess Beatrice Kimera who was born and raised at this Home. She was summoned to Hoima CPS   that she had trace passed and maliciously damaged Kamurasi’ bananas and tomatoes Vide SD 71/22/08/16 of Hoima CPS. She was informed that Kamurasi David Steven owns the said land and that their father had given him the land before his death and he has a tile transferred to his names on 15th/April/2015 after a caveat had been lodged on the Will.

Of interest to note is whether Kamurasi David Steven could have fraudulently transferred land to his own names.

Fraudulent transfer

  1. i) The property is an ancestral Burial ground for the  Rwakiswaza lineage
  2. ii) The same land in question is listed in the will (page 3 6(iii) among the property of our late father

iii)           Property is listed in the petition for probate by executors’ dates’ 30th/March/ 2015.

  1. iv) The will is being challenged in High court and therefore there is no administrator to the estate and no letters of administration or probate ought not to have been given by any court. This matter had caused a lot of anxiety and both parties await for court’s decision after the hearing.
