Top K to be charged for defilement

Jinja based recording artiste Ronald Bamukisa alias Top K is under police custody following reports that he defiled a 13 year old girl

On 5th, February, 2023, he was arrested at Green Summer bar and lodge in Jinja City Southern division during a police operation that was aimed at getting rid of crime in the district

According to Kiira regional police spokesperson James Mubi, the suspect locked himself inside the bar, prompting the bar attendants to alert police officers, who forcefully opened the door and arrested him.

He said the suspect is still at Jinja central police station awaiting prosecution.

“He (Top K) was conducting music shows in Kayunga and Jinja district where he mobilized young girls to act as dancers and many parents entrusted him with their daughters but they became suspicious of his activities mid-last month when he started asking them to allow their children to conduct overnight rehearsals at his preferred location without supervision from female caretakers,” he said in his address to the media

The father of the girl, whose names have been withheld said that Bamukisa left Kayunga with his daughter on Friday 3rd, Feb, 2023 without his authorization and only to be informed on Sunday that the two had been arrested from Green Summer lodge in Jinja city.

Bamukisa has since denied the allegations leveled against him, saying that he never had sexual intercourse with the minor.

According to the available literature, defilement is where a person (offender) performs a sexual act with a child (victim).

Offenders that can be arrested and charged: adult (18 years and above).

It is assumed by law that a child of 12 years and below cannot be capable of knowing the difference between right and wrong and should therefore not be held criminally responsible.

Consent to the sexual act and/or someone not getting pregnant are not defenses.

In cases of defilement, issues of consent and pregnancy are irrelevant.

This means that whether one has agreed to it or has not ended up pregnant is not a defence.

The sexual act itself is seen as a crime by law.

Already the attempt to commit defilement is an offence and therefore punishable.

So where one tries to perform a sexual act with a child (below 18 years) and does not succeed, the matter can still be reported to police and the culprit arrested and convicted if found guilty.
